Terms & Conditions
The following terms and conditions apply to all sales transactions on this website ("the Conditions"). All orders are made subject to the acceptance by you of the Conditions, which are deemed to be accepted on the placing of the order.
- These Conditions do not affect your statutory rights. All goods are sold with the benefit of a 12 month manufacturers guarantee and it is your responsibility to complete and return to the manufacturer the purchase registration form enclosed with the goods.
- We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You are deemed to accept the Conditions when you place an order for goods with us. Our contract begins when we accept your offer to purchase goods by sending an e-mail (either from ourselves or from our agent) to confirm that your order has been received and accepted. This process will not take place (and we will not be deemed to have accepted your order) until we have validated your credit card and order details. We may use a credit agency to verify your details. Any communication which you receive from us prior to validation is not to be deemed acceptance of your order.
- Many of the goods we sell are of a technical nature and it is not practical to publish detailed specifications of all the goods. The description of the goods are as set out on the website. All drawings, photographs, descriptive matter, specifications and advertising on our web site are for the sole purpose of giving an approximate idea of the goods. They will not form part of the contract between us.
- Your order for goods is subject to stock availability. If we cannot supply goods to you for any reason we will inform you of the reason and will not charge you for those goods, and will refund you any money already paid by you for the goods.
- Delivery of the goods shall be made to an address within Great Britain and must be signed for. The address will be that registered with your payment card issuer, unless you request otherwise in writing and we agree to such request (at our sole discretion).
- We will endeavour to deliver goods for orders placed before 3.00 pm, Monday to Friday, within four working days (with the exception of public holidays) but time shall not be of the essence. We shall not be liable for any loss which may be suffered by you caused by any delay of delivery unless caused by our negligence. If delivery of the goods is delayed by more than 14 days, you shall be entitled to contact us and cancel the order. Any monies paid in respect of goods which are not delivered will be refunded.
- Goods, other than faulty goods, may be returned within 7 working days of receipt by you of such goods. All such goods must be returned in an "as new" condition complete with all packaging and accessories and must not have not been opened.The return delivery charges must be paid by you. Where any goods are returned in accordance with this clause, we shall, within 14 days of our receipt of such returned goods, reimburse any monies paid by you for those goods (excluding any delivery costs incurred by us).
- Risk of damage to or loss of goods shall pass to you on delivery.
- Ownership of the goods shall not pass to you until we have received payment in full (in cash or cleared funds). If you return the goods, then title shall revert to us when the goods are returned.
- The price for the goods is in pounds sterling and shall be the price, inclusive of VAT, set out on the web site at the time your order is placed. A delivery charge which is inclusive of VAT will be applied to all orders. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any new taxes or duties, or if due to an error or omission the price published for the goods on our website is wrong. We tr ensure that all prices displayed on our website are accurate, but the price of the goods on your order will need to be validated by us prior to processing your order. We will inform you of the correct price and give you an opportunity to cancel the order. If the goods have already been delivered, we will give you an opportunity to return the goods and receive a full refund of the price and any delivery charges you have paid for the goods.
- Payment for goods must be made by you in accordance with our purchase procedure as set out on our website. All orders are positively credit card sanctioned prior to despatch. We can accept no responsibility if any details you provide us with are incorrect or if any order is held up as a result of incorrect details.
- We shall not be liable to you for any failure or delay in performance of our contract if it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.
- If goods arrive in a damaged condition you must inform us as soon as practicable. We shall arrange collection of the goods and we will either replace the goods at no extra charge, or refund any money paid by you for the goods. If the goods returned under this condition 14 are found not to be defective and to be in full working order they will be returned to you and an administration fee of 15% of the price of the goods along with the cost of carriage of will be charged to you.
- You shall not be entitled to a refund or replacement of damaged goods if the defect arises because you fail to follow our instructions as to the storage, installation, commissioning, use or maintenance of the goods or you alter or repair such goods without our written consent.
- Goods returned for repair or replacement must be packaged in an appropriate manner to avoid any damage to the equipment during transit.
- These terms are subject to English law and the parties agree to submit to the exclusive jurisdiction of the English Courts.
- Use of Information
17.1 We may search the files of credit reference agencies which will keep a record of that search. We may also carry out identity and anti-fraud checks with fraud prevention agencies. If You give false or inaccurate information to us and We suspect fraud, We may record this. Details of how You conduct your account may also be disclosed to those agencies. The information may be used by us and other parties in assessing applications for and making decisions about credit, credit related services and insurance (including motor, household credit, life and other insurances and claims) from You and members of your household and for debt tracing, debt recovery, credit management and crime, fraud and money laundering detection and prevention. Information may be used by us and other parties for checking Your identity, statistical analysis about credit, insurance, fraud and to manage Your account and insurance policies. We may also perform subsequent searches for the purpose of risk assessment, debt collection and fraud prevention with one or more credit reference agencies and/or fraud prevention agencies whilst You retain a financial obligation to us.
17.2 You authorise us to use and disclose, in the UK and abroad, information about You and use of the Services and how You conducts Your account for the purposes of operating Your account and providing You with the Services or as required under law to our associated companies, partners or agents, any debt collection agency or credit reference agency and fraud prevention agency and other users of these agencies who may use this information for the same purpose as us. You agree to this information being used by us for credit control purposesand fraud and crime detection and prevention. You can obtain further details from public registration held by the Information Commissioner. If You wish to aedetails of the credit reference or the fraud prevention agencies from whom We obtain and with whom We record information about You or receive a copy (We may charge a fee) of the information We hold about You, please contact us by writing to the Data Controller at Martin Dawes Limited, Martin Dawes House, Europa Boulevard, Westbrook, Warrington, WA5 7WH.
17.3 You also agree to the information described in paragraph 16 being used, analysed and assessed by us and the other parties identified in paragraph 16 and selected third parties for marketing purposes including amongst other things to identify and offer You by phone, post, SIM Card, e-mail or other means, any further products, services and offers which We think might interest You. If You do not wish Your details to be used for marketing purposes, please write to The Data Controller, Martin Dawes Limited, Martin Dawes House, Europa Boulevard, Westbrook, Warrington WA5 7WH.
